California Gov. Arnold Schwarzenegger recently signed into a law a bill to regulate the state’s life settlement market that includes a ban on stranger-owned life insurance policies.

The Republican governor’s approval came one year after he vetoed similar legislation because it didn’t provide enough disclosures to consumers.

The law, authored by Sen. Ron Calderon (D-Montebello), chair of the California Senate Banking, Finance and Insurance Committee, mandates that policy owners not enter into a life settlement for at least two years after a policy is issued.

In STOLI arrangements, investors often solicit policy owners who are paid a small fee in return for turning over the life policy obtained in their name to investors. States have been battling over STOLI for several years.

The law prohibits life insurance companies from restricting lawful policy ownership transfers and from restricting their life agents from telling clients that life settlements can be an alternative to surrendering or obtaining the cash value of a life insurance policy.

The law also provides 30 days after signing or 15 days after receiving proceeds for a life settlement seller to change his or her mind and cancel the agreement.

California law now defines a life settlement as the sale of an existing life insurance policy to a third party for more than its cash surrender value but less than its net death benefit.

Current Market Conditions have Created a Window of Opportunity for LS Investors

As a result of the factors listed below, investors are able to acquire life settlements at very aggressive rates, which a eventual result is strong returns for the investors.

1. Fall out from the financial crisis In late 2008, caused capital of major institutions to evaporate while banks scrambled to straighted up balance sheets lowering activity, including the purchase of life settlements.

2. There has been an alteration in the tables that calculate life expectancies. Recently, life expectancy projections on average were raised and that had a significant impact on amount and formulatino of investment returns.

3. Distressed Portfolios. Many funds and investors find themselves with insufficient reserves to maintain premium payments in this current economic crisis.

4. The number of sufficient policies has exceeded demand in many markets, do to those markets having less money available. Investors have become much more selective and are in a position to “cherry pick” the best policies.

“The LS market rallied from 2005 until late 2008 when it hit the breaks along with the rest of the investment community. Investors now see a window of opportunity for increased returns given current market conditions and rates. Right now it’s a buyers market. There is no better time to consider the opportunity,” said MCC President, David Mickelson.

MCC projects, as more money comes in to the market and inventory is acquired, supply and demand will balance out and pricing will go up. Now is a time for investors to make inquiries, now while market conditions are optimal, and it is also a great time for individuals to have their policy evaluated.

Found this article today while reading Citywire, this is discussing UK based funds, however there business and actions are sometimes US based as well…

As the hunt for income gets ever more desperate in the low interest rate environment, life settlement funds on paper offer an attractive proposition, but wealth managers remain cautious about using them for their clients.

Lots of question marks have been raised over these funds with the trading of life settlement policies for a profit deemed to be unethical in some quarters. There have also been issues about a lack of transparency.

However, some parts of the market appear to have cast aside these concerns. In March, the £250 million EEA LIfe Settlement fund attacted more than £28 million in inflows, which is impressive given many retail funds have haemorrhaged money in recent months.

The fund boasts 38 consecutive months of positive returns. It is on a yield of 4% and returned 11.8% in 2008.

The fund’s manager, Peter Winders, admits investors looked at the figures and harboured a ‘too good to be true mentality’, particularly in the post-Madoff age.

There were also concerns about the liquidity of life settlement funds.

The emerging market place called Life Settlement recently has been featured in publications such as the New York Times, Wall Street Journal and BusinessWeek. That market place is changing the way many seniors will think about their unwanted life insurance policies. Life Settlements is a rapidly growing sector in the financial markets and many of the large Wall Street firms are rushing to capitalize on this asset class, particularly with mortgage-backed securities being so volatile. As reported in BusinessWeek (July 30, 2007), industry analysts estimate that the life settlement market currently is a $30 billion industry and is expected to exceed $160 billion annually by the year 2030. The investors who buy life settlements are some of the world’s largest investment firms, including Deutsche Bank, Credit Suisse, Cantor Fitzgerald, Berkshire Hathaway,Merrill Lynch and many more. (They continue to make the payments on the policy, so that when you die, the investment firm gets the proceeds.)

Found this on Craigslist, might be helpful to some people out there.

Ever wonder why your life insurance premiums seem higher than you think they should be? Want to know how life settlement works and what type of health histories bring in larger settlement amounts?

I’ve been a life insurance underwriter for 14 years. I can tell you what health conditions and test results are considered favorable or unfavorable in the market.

If you want to know how your health history will be viewed BEFORE you contact your insurance agent or life settlement advisor then contact me. I can review your medical records and tell you the favorable and unfavorable factors that may effect your chances of obtaining a life insurance policy or a life settlement.

I charge $50.00 for a review of medical records up to 300 pages, $75.00 for a review up to 500 pages and $100.00 for records over 500 pages. Keep in mind this is a gross count regardless of the number of doctors these records came from. Additonally, I don’t check every page for duplicate information. If payment is made by bank check/money order sent along with the records I will return your records along with a copy of my review. If you send a personal check I will return your medical records within 72 hours but will wait one week before sending my review.

I do not order medical records you will need to provide copies of your medical records to me. I recommend records be sent to me with a return signature request. Medical records will be returned to the location of your choice via US mail, Fed Ex, or UPS with a return signature request(unless a PO box is used).

I do not need your name or social security number to complete this process just your sex and age and an address to return your records to. If you are concerned about your privacy black out your name and social security number where it appears in your records and send a money order/bank check instead of a personal check, and provide a PO box to return your records to (no return signature request in this case).

I do not copy, keep, or store records longer than it takes to review them so, depending on volume, records are usually returned to you within 72 hours.

I DO NOT sell insurance. I DO NOT diagnose medical conditions.

Please send records to:

Here is a life settlement case example and testimonial.

Age of Insured: 76
Policy’s Face Value: Portfolio of $6,500,000
Sale Price: $1,993,000
Use: Sold company’s unwanted key-man insurance to fund new ventures rather than continuing to pay out-dated premiums.

Recently, James R, CFO of a mid sized national company, was doing due diligence for the acquisition of a competitor company. He found that the company being purchased owned two key man term life insurance policies on the current owner (age 76). The policies had a total face amount of $6,500,000. Typically, since the policies would no longer be needed and they were term policies with no cash value, the premiums would be a unnecessary additional expense.

Most purchasers would either allow the retiring insured to take over the policies or lapse them once the transaction was complete. It came to mind that he had heard a speaker at a recent CFO conference talking about Life Settlements. He decided to do some research. During his research he found LifeSettlementAwareness.com on the internet. Said Ryan, “They arranged for an Insurance Professional in my area to meet with me at my office. He was extremely knowledgeable and not only provided me with an in depth explanation of how a Life Settlement transaction works but also gave me some insight on possible application of the proceeds of the transaction.

He also shared with me how Life Settlements can be used as a powerful business and personal financial planning tool. Something my old insurance man had never done. He confirmed the fact that, instead of lapsing or surrendering the term policies, they could quite possibly be sold for a significant amount of cash to a third party. My company was fortunate to have found LifeSettlementAwareness.com. Through their network of Master Brokers, we were able to obtain multiple offers and get top dollar for the policies. The money we could have lost by terminating the term policies was phenomenal. In the process, we also found out that other Universal Life policies on certain key men who were nearing retirement could be sold as well. My being aware of Life Settlements when the seller was not made a nearly $2,000,000 positive economic impact on my company. Needless to say, my CEO is pretty happy.”

The 14th Annual Life Insurance Settlement Association Conference in Orlando, FL the other day was very good for consumers wishing to find out more information on life settlements and Viatical Settlements. The industry has pledged to consumers that it wants to dispel current opinions on Life Settlements that has been put forward by the national media and other sources. They also are looking to increase their legislative advocacy to help clarify their credibility to their consumers.

This is one of many very positive moves by Life Settlement providers in their quest, to not only increase business, but also clear a lot of the misconceptions that has surrounded Life Settlements. Life Settlements, the purchasing of out of date, irrelevant, or overly expensive life insurance policies by investors in exchange for large cash settlements, have been under fire recently due to media coverage of some state regulators and industry watchdogs cracking down on a few illegal operators. However, this is a good thing for consumers and providers, and the Life Settlement industry is definitely moving in the right direction by attempting to inform consumers on the difference between a few illegal operators and the hugely safe and profitable Life Settlement Market.

Traditionally, life insurance has not been a part of financial planning. Most financial planners did not factor life insurance as an investment, but as a necessity, or they were unaware that a product existed that could turn a negative investment like life insurance into a positive windfall of cash. When an insurance policy is purchased, it is under the assumption that the purchaser will not personally benefit from the invested premiums, but his/her beneficiaries will. The future prospect of return of the invested premium is the justification for funding an extremely expensive and negatively amortizing product like life insurance. However, Senior Life Settlements have been created to help alleviate the burden of these policies when the needs, feasibility, or affordability of the policy has changed.
